Webinar Fuel, LLC ("Webinar Fuel," "we," "us," or "our") thanks you for visiting and using the websites, software platforms, applications, digital products, online services, and other online or mobile resources that we own, operate, or control. This Privacy Policy ("Policy") describes how we collect, use, disclose, store, protect, and otherwise process Personal Information when you access or use our websites, applications, software, APIs, features, tools, products, and related services, including https://www.webinarfuel.com, https://www.webby.app, https://www.challengefuel.com, and any subdomains, applications, software platforms, or digital properties that Webinar Fuel currently owns, operates, or may own or operate in the future (collectively, the "Services").

For purposes of this Policy, "you" and "your" mean visitors to our Services, Customers and prospective Customers, account users, individuals who communicate with us, and, where applicable, End Users whose Personal Information is processed through the Services. By accessing or using the Services, you acknowledge that you have read and understand this Policy.

California Notice of Collection of Personal Information: California residents can learn more about the categories of Personal Information we collect, the purposes for which we use it, and their rights by reviewing the sections titled "California Privacy Rights and Notice at Collection" and "Online Tracking Technologies, Advertising, and Opt-Out Signals."

Important Definitions

The following definitions apply throughout this Policy. Some terms may also have the meanings assigned to them under applicable Data Protection Laws.

"Customer" or "User" means an individual or entity that creates an account, purchases, subscribes to, accesses, or otherwise uses the Webinar Fuel software or Services.

"Customer Data" means Personal Information, content, files, records, leads, contacts, webinar registrant information, attendee information, subscriber information, analytics, or other data uploaded to, submitted to, stored in, or processed through the Services by or on behalf of a Customer.

"End User" means a person whose Personal Information is uploaded to, submitted to, stored in, or processed through the Services by or on behalf of a Customer, including webinar registrants, attendees, leads, contacts, subscribers, purchasers, prospective customers, or other recipients of Customer Communications.

"User Content" means any content, materials, data, or information uploaded, created, hosted, transmitted, displayed, distributed, or otherwise made available by a Customer or User through the Services, including webinar presentations, scripts, recordings, offers, landing pages, registration pages, forms, emails, SMS/text messages, push notifications, chat content, files, images, videos, and marketing materials.

"Communications" means email messages, SMS/text messages, push notifications, in-app messages, webinar reminders, follow-up messages, and any other electronic or digital messages sent by a Customer or on a Customer's behalf through the Services.

"Personal Information" or "Personal Data" means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked to an identified or identifiable person or household, and includes any information treated as personal information, personal data, or personally identifiable information under applicable law.

"Data Protection Laws" means applicable privacy, data-protection, marketing, advertising, and communications laws, including, as applicable, the EU General Data Protection Regulation, the UK GDPR and Data Protection Act 2018, the California Consumer Privacy Act as amended by the California Privacy Rights Act, and other U.S. state privacy laws.

Who We Are and Our Role

Webinar Fuel is a software company that provides a technology platform enabling Customers to build, launch, automate, host, and deliver webinars and related online experiences. The Services also allow Customers to collect registrant information, manage leads and attendees, analyze webinar performance, and send Communications such as email, SMS/text messages, and push notifications to contacts designated by the Customer.

For Personal Information we collect directly about visitors to our websites, our own Customers, prospective Customers, account users, vendors, business partners, workforce members, applicants, and individuals who communicate directly with Webinar Fuel, Webinar Fuel generally acts as the controller, business, or equivalent legal role responsible for that Personal Information.

For Personal Information that a Customer uploads to, stores in, or processes through the Services about its End Users, Webinar Fuel generally acts as a processor, service provider, or contractor on behalf of the Customer. In those circumstances, the Customer is the controller, business, or equivalent legal role responsible for determining the purposes and means of processing, the lawful basis for processing, the content and timing of Communications, and the notices and consents required for End Users.

Where applicable, the processing of Customer Data is also governed by our Data Processing Addendum ("DPA") and the Terms of Service located at https://webinarfuel.com/terms-wf.

Customer Data Ownership

As between Webinar Fuel and the Customer, the Customer retains all rights, title, and interest in Customer Data uploaded to, submitted to, stored in, or processed through the Services on behalf of its End Users. Webinar Fuel does not claim ownership of Customer Data.

Webinar Fuel processes Customer Data solely to provide, maintain, secure, support, improve, and operate the Services; to comply with Customer instructions; to comply with applicable law; to protect the security, integrity, and availability of the Services; and otherwise as permitted by the Agreement, the DPA, and applicable law. We do not use Customer-uploaded End User contact lists for Webinar Fuel's own direct marketing unless the End User separately provides information directly to Webinar Fuel or the use is otherwise permitted by applicable law and the governing agreements.

Who We Collect Personal Information From

We may collect Personal Information from the following groups of data subjects:

Visitors to and users of our websites, applications, and online or mobile resources;
Customers, prospective Customers, account owners, administrators, and team members;
End Users whose information is uploaded to or processed through the Services by Customers;
Individuals who register for webinars, events, programs, or Services that we host or operate directly;
Individuals who communicate with us by email, phone, SMS/text message, chat, form submission, social media, or other means;
Current members of our workforce, job applicants, contractors, vendors, service providers, and business partners; and
Individuals whose information we receive from affiliates, advertising partners, analytics providers, payment processors, fraud-prevention providers, public sources, or other third parties as permitted by law.

The categories of information we collect from each group, and how we use it, may differ. The same person may fall into more than one category.

What We Collect

We collect Personal Information in several ways, including information you provide voluntarily, information collected automatically, information we receive from Customers, and information we receive from third parties.

Information You Provide Voluntarily

If you participate in certain activities through the Services, you may be asked to provide information about yourself. The types of Personal Information collected may include identifiers, professional or business information, payment-related information, account information, and communications content. If you do not want us to collect this type of information, please do not provide it; however, not providing certain information may limit your ability to use portions of the Services.

Examples include:

Emails and online forms. When you send us an email, submit a form, request support, ask a question, or otherwise contact us, we may retain your email address, phone number, name, company, message content, attachments, and other information you provide to respond to you, process your request, maintain records, and provide information about products or services that may be of interest to you.

Account registration. When you register for an account, we may collect your name, email address, phone number, company name, account credentials, role, profile information, preferences, and other information required to create and manage your account.

Purchases and subscriptions. When you purchase or subscribe to Services, we may collect billing contact information, transaction details, tax information, account status, plan selections, usage information, and related records. Payment-card information is processed by third-party payment processors as described below.

Events and webinars we host directly. When you register for webinars, services, events, conferences, challenges, programs, or other offerings that Webinar Fuel itself hosts, we may collect identifiers, contact information, registration information, payment information if applicable, attendance information, and communications preferences.

Surveys, contests, promotions, feedback, and community features. We may collect information you voluntarily provide when participating in surveys, promotions, feedback requests, interactive areas, communities, social features, or other features of the Services.

Integrations, APIs, and webhooks. If you connect third-party integrations, APIs, webhooks, or external services to the Services, we may receive information necessary to operate the integration, authenticate the connection, transmit data, synchronize records, and provide support.

Workforce, applicants, vendors, and business partners. If you apply for a role, provide services to us, or engage with us as a vendor or partner, we may collect contact information, professional information, employment information, payment information, tax information, and other information reasonably necessary for that relationship.

Customer Data and End User Information

Customers may upload, submit, collect, store, or process Personal Information about End Users through the Services. This may include names, email addresses, phone numbers, webinar registration information, attendance and engagement data, chat interactions, poll responses, survey responses, purchase or conversion events, UTM parameters, source and referral information, tags, segmentation data, custom fields, consent records, opt-out status, and related information.

Customers are responsible for ensuring that they have the rights, notices, consents, permissions, and lawful bases required to collect, upload, store, use, transmit, and otherwise process End User Personal Information through the Services. Webinar Fuel processes this information as a processor/service provider for the Customer except where we expressly state otherwise or where applicable law requires a different role.

Information Collected Automatically

When you visit or use the Services, information may be collected automatically through your browser, device, server logs, cookies, pixels, SDKs, scripts, APIs, web beacons, local storage, and similar technologies. This information may include:

IP address, domain name, browser type and version, operating system, device type, device identifiers, mobile carrier, language settings, and time zone;
Pages viewed, links clicked, buttons clicked, forms submitted, documents downloaded, features used, dates and times of visits, session duration, and interactions with emails, advertisements, webinars, and Services;
Referring URLs, initial referrers, referring domains, search engines, search keywords, UTM parameters, campaign tags, and attribution information;
Screen height, screen width, approximate location derived from IP address, and, if enabled and permitted, more precise location information;
Cookie identifiers, advertising identifiers, analytics identifiers, and other online identifiers; and
Diagnostic, crash, performance, security, fraud-prevention, and usage data.

We use automatically collected information to administer the Services, provide functionality, remember preferences, understand usage, measure performance, improve the Services, detect and prevent fraud and abuse, provide support, deliver and measure advertising, and protect our systems and users.

Information From Third Parties

We may receive Personal Information from third parties such as payment processors, fraud-prevention providers, analytics providers, advertising networks, social media platforms, affiliate partners, integration partners, data enrichment providers, public databases, and Customers who use the Services. We use such information as described in this Policy and as permitted by applicable law.

User Content, Webinars, and Customer-Controlled Communications

Technology Provider Only

Webinar Fuel provides software tools only. We do not create, review, approve, verify, endorse, guarantee, or control User Content, including webinars, presentations, recordings, scripts, claims, offers, landing pages, emails, SMS/text messages, push notifications, or other Communications created or sent by Customers or Users through the Services.

User Responsibility for Webinar Content

Customers and Users are solely responsible for all User Content they create, upload, host, transmit, display, distribute, or otherwise make available through the Services. This responsibility includes ensuring that webinars, offers, claims, Communications, and related materials are lawful, accurate, non-deceptive, properly substantiated, and compliant with all applicable laws, regulations, industry standards, platform rules, and self-regulatory guidance.

Without limitation, Customers and Users are solely responsible for required disclosures, including advertising disclosures, endorsement disclosures, earnings disclaimers, health disclaimers, financial disclaimers, investment disclaimers, affiliate disclosures, sponsorship disclosures, and any other disclosures required by law or applicable industry standards. Customers and Users are also solely responsible for ensuring that they have all rights, licenses, consents, and permissions required to use any names, likenesses, trademarks, copyrights, music, images, videos, testimonials, claims, data, or other materials included in User Content.

Webinar Fuel shall not be responsible or liable for User Content or for any claims, damages, fines, penalties, losses, complaints, investigations, or disputes arising out of or relating to User Content.

Customer-Controlled Communications

The Services allow Customers to send Communications, including email, SMS/text messages, push notifications, and other electronic messages, to recipients selected or designated by the Customer. Webinar Fuel does not select recipients, determine message content, determine message timing or frequency, or determine the legal basis for sending Customer Communications.

Customers are solely responsible for obtaining all required consents, permissions, authorizations, and lawful bases for Communications sent through the Services and for complying with all applicable laws, rules, and regulations, including, without limitation, the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, Canada's Anti-Spam Legislation (CASL), GDPR, UK GDPR, ePrivacy rules, state mini-TCPA laws, wireless carrier rules, platform policies, and similar international, federal, state, provincial, and local laws and standards.

Customers are solely responsible for honoring opt-out, unsubscribe, revocation-of-consent, "STOP," suppression-list, and similar requests as required by law and for maintaining records of consent and compliance.

Sender and Originator Clarification

For Communications sent through the Services by or on behalf of a Customer, the Customer is the sender, originator, initiator, and party responsible for the Communication. Webinar Fuel acts solely as a technology service provider that enables transmission at the Customer's direction.

No Duty to Monitor

Webinar Fuel has no obligation to review, monitor, screen, police, edit, or verify User Content, Customer Data, or Customer Communications. Any enforcement actions we may take, such as suspending an account, restricting a feature, removing or disabling content, or investigating suspected misuse, are discretionary and do not create a duty, responsibility, or liability for User Content, Customer Data, or Customer Communications.

Liability limitations, indemnification obligations, acceptable use rules, and other contractual protections are governed by our Terms of Service and any applicable agreements between Webinar Fuel and the Customer.

Public Forums, Community Features, and User-Generated Content

Some Services may include community features, public forums, comments, chat, social features, or interactive areas that allow users to post messages, comments, files, images, or other materials. If you choose to use these features, the information you post, including your screen name and any Personal Information included in your content, may be public and may not be protected by this Policy in the same manner as information you provide directly to us.

You are solely responsible for any content, materials, messages, comments, files, or other information that you post, upload, transmit, or otherwise make available through community features, forums, social features, or interactive areas of our Services. We do not endorse, verify, or guarantee the accuracy, completeness, or legality of user-generated content and are not responsible for any such content. We reserve the right, but do not have the obligation, to monitor, remove, restrict, or disable content at our discretion for any reason, including violations of law, our Terms of Service, or our policies.

How We Use Personal Information

We use Personal Information for business, commercial, operational, security, legal, and other purposes described in this Policy. These purposes may include:

Providing, operating, maintaining, hosting, and supporting the Services;
Creating, managing, authenticating, and securing accounts;
Processing purchases, subscriptions, orders, credits, renewals, billing, taxes, refunds, and related transactions;
Providing customer service, technical support, troubleshooting, onboarding, account management, and training;
Responding to inquiries, support requests, privacy requests, disputes, complaints, and legal requests;
Sending service-related, transactional, account, billing, security, and administrative communications;
Sending marketing, promotional, newsletter, event, product, or educational communications where permitted by law;
Personalizing content, improving user experience, remembering preferences, and making the Services more convenient;
Measuring, analyzing, testing, developing, improving, and optimizing the Services, features, advertising, campaigns, and content;
Diagnosing problems with our servers, applications, systems, and Services;
Detecting, investigating, preventing, and responding to fraud, abuse, spam, unauthorized transactions, security incidents, illegal activity, policy violations, and other harmful conduct;
Protecting the security, integrity, availability, and lawful operation of the Services and our business;
Administering contests, promotions, surveys, webinars, events, or other features;
Facilitating integrations, APIs, webhooks, data imports, data exports, and customer-selected third-party services;
Complying with applicable laws, regulations, legal obligations, law-enforcement requests, court orders, subpoenas, and governmental requests;
Exercising, establishing, or defending legal claims; and
Any other purpose disclosed at the time information is collected or with your consent.

Legal Bases for Processing

Where a legal basis is required, we process Personal Information based on one or more of the following:

Performance of a contract or steps taken before entering into a contract, including providing the Services you request;
Our legitimate interests, such as fraud prevention, network and information security, direct marketing where permitted, analytics, product improvement, customer support, business operations, and protecting our legal rights;
Consent, where required by law, such as for certain marketing communications, cookies, or other processing activities; and
Compliance with legal obligations.

If we rely on consent, you may withdraw consent at any time, but withdrawal will not affect processing that occurred before withdrawal. Where we rely on legitimate interests, you may have the right to object depending on your jurisdiction.

Automated Processing, Artificial Intelligence, and Decision Support

Certain features of the Services may use automated processing, algorithms, artificial intelligence, machine learning, analytics, or similar technologies to provide functionality, recommendations, insights, reporting, routing, personalization, fraud prevention, support, or performance optimization. These processes are designed to support users and improve the Services, but they do not replace human judgment.

We do not use automated processing to make decisions about individuals that produce legal or similarly significant effects unless we provide any notices, rights, and safeguards required by applicable law. We do not guarantee the accuracy, completeness, suitability, or legality of automated outputs for any particular purpose. Customers and Users are responsible for reviewing outputs and determining whether and how to use them.

Software, Data, and Analytics Disclaimer

Our software, platforms, tools, dashboards, reports, analytics, recommendations, and other automated features are provided on an "as is" and "as available" basis. While we strive to provide accurate and timely information, we do not guarantee that any data, metrics, reports, analytics, recommendations, or outputs will be accurate, complete, current, or error-free.

You acknowledge that reliance on information, data, analytics, reports, or recommendations generated through the Services is at your own risk. We are not responsible for business decisions, financial losses, missed opportunities, compliance failures, or other outcomes resulting from your use of or reliance on such information, except to the extent required by applicable law.

Marketing, Testimonials, and Results Disclaimer

Our websites, software, courses, programs, webinars, emails, advertisements, and other marketing materials may include examples of results, testimonials, case studies, projections, or statements about potential outcomes. These examples are provided for illustrative purposes only and are not intended to represent or guarantee that you will achieve the same or similar results.

Any results discussed are not typical. Your results will vary based on many factors, including your background, experience, effort, implementation, market conditions, industry, offer, audience, advertising, business decisions, and other factors outside our control. We do not guarantee any specific outcome, income level, profit, performance, conversion rate, deliverability rate, attendance rate, or success.

Our products and services are educational, informational, and software-based in nature and do not constitute legal, financial, tax, medical, investment, or other professional advice. You are solely responsible for evaluating the accuracy, usefulness, compliance, and applicability of any information provided and for your own business decisions and results.

When and With Whom We Share Personal Information

We may disclose Personal Information as described below and as otherwise disclosed at the time information is collected, with your consent, or as permitted or required by law. We do not sell Personal Information for money. Certain disclosures for cross-context behavioral advertising, targeted advertising, analytics, or similar activities may be considered a "sale," "sharing," or "targeted advertising" under some privacy laws; where applicable, we provide opt-out rights.

Affiliates

We may share Personal Information with our affiliates, related entities, commonly controlled companies, and family of companies. They may use the information in a manner consistent with this Policy, including to provide, support, improve, market, and operate products, services, initiatives, or offerings that may be of interest to you, where permitted by law.

Service Providers, Vendors, Subprocessors, and Business Partners

We may share Personal Information with service providers, vendors, subprocessors, contractors, and business partners who perform services for us or help deliver the Services. These may include hosting providers, infrastructure providers, payment processors, communications providers, email providers, SMS providers, push-notification providers, analytics providers, advertising and measurement providers, fraud-prevention providers, customer-support tools, data-storage providers, security providers, tax and accounting providers, professional advisors, and integration partners selected by Customers.

We attempt to disclose only the information reasonably necessary for such parties to perform their functions. Where required by law, we seek to bind such parties by written contracts requiring confidentiality, appropriate security, limited use, and compliance with applicable privacy obligations. Although we use commercially reasonable efforts to work with reputable providers and impose contractual safeguards, no third-party relationship, security measure, or contractual control can guarantee perfect compliance or eliminate all risk.

Customer-Selected Integrations and Third-Party Services

If a Customer chooses to connect the Services with third-party applications, integrations, APIs, webhooks, payment platforms, CRM systems, email providers, SMS providers, advertising platforms, analytics platforms, or other services, we may disclose Customer Data and End User information as directed by the Customer. Webinar Fuel is not responsible for the privacy, security, or data practices of third-party services selected or enabled by a Customer.

Advertising, Analytics, and Marketing Partners

We may disclose limited Personal Information, such as online identifiers, cookie identifiers, device information, hashed email addresses, usage data, and event data, to advertising, analytics, and measurement partners to deliver, measure, personalize, suppress, or improve advertising and marketing, where permitted by law. Depending on your jurisdiction, this may be considered a sale, sharing, or targeted advertising, and you may have the right to opt out.

Legal, Safety, and Compliance Disclosures

We may disclose Personal Information to government authorities, courts, law enforcement, regulators, auditors, advisors, and other third parties when we believe disclosure is required or permitted by law, necessary to respond to court orders, subpoenas, legal process, law-enforcement requests, or governmental requests, or appropriate to protect our rights, property, safety, users, Customers, End Users, service providers, systems, or the public.

We may also disclose information when we have reason to believe someone is causing injury to or interference with our rights or property, the rights or property of other users, the Services, or anyone else who could be harmed by such activities.

Business Transfers

If Webinar Fuel or any of its affiliates, or substantially all of its or their assets, are involved in a merger, acquisition, financing, reorganization, sale, consolidation, bankruptcy, receivership, liquidation, or other business transaction, Personal Information may be disclosed, transferred, or made available as part of that transaction or related diligence, subject to applicable law.

Aggregated, Deidentified, and Anonymized Information

We may use and disclose aggregated, deidentified, or anonymized information that does not reasonably identify you, including for analytics, benchmarking, research, product improvement, marketing, reporting, and business purposes. Where required by law, we maintain and use deidentified information in deidentified form and do not attempt to reidentify it except as permitted by law.

Email Communications, Newsletters, SMS, and Marketing

We may use Personal Information to contact you with service-related messages, transactional notices, account communications, billing notices, security alerts, newsletters, marketing, promotional materials, event information, product updates, or other information that may be of interest to you.

You may opt out of non-transactional marketing emails from Webinar Fuel by following the unsubscribe link or instructions provided in the email or by contacting privacy@webinarfuel.com. Some communications are transactional or service-related, such as account notices, security alerts, billing notices, purchase confirmations, and legal notices. You may not be able to opt out of those communications while using the Services.

If you consent to receive SMS/text messages or similar Communications directly from Webinar Fuel, you may opt out by following the instructions in the message, including by replying "STOP" where applicable, or by contacting privacy@webinarfuel.com. Standard message and data rates may apply.

For Communications sent by Customers through the Services, the Customer is the sender and is responsible for obtaining consent, providing notices, honoring opt-outs, and complying with applicable laws. If you receive a Customer Communication through the Services, you should contact the Customer that sent the Communication regarding consent, unsubscribe, deletion, or other requests. We may assist Customers with such requests as their processor/service provider where required by our agreements and applicable law.

Payments

We may provide paid products or services. If you make a payment, your payment information may be processed by third-party payment processors. We do not store full payment-card details unless expressly stated and permitted; payment-card information is generally provided directly to our payment processors, whose use of Personal Information is governed by their own policies and contractual obligations.

Payment processors may adhere to standards such as the Payment Card Industry Data Security Standard (PCI-DSS), which is designed to help ensure the secure handling of payment information. We may receive payment status, transaction IDs, billing contact information, partial card details, subscription information, fraud signals, and other information necessary to process transactions, reconcile payments, provide support, prevent fraud, and maintain records.

Fraud Prevention, Abuse Prevention, and Disputes

To protect against fraud, unauthorized transactions, abuse, spam, misuse, account compromise, non-compliant messaging, and illegal activity, we may monitor transactions, accounts, usage patterns, Communications activity, system events, and other relevant data. We may share relevant information with payment processors, financial institutions, fraud-prevention services, communications providers, carriers, platform providers, law enforcement, legal advisors, and other parties as permitted by law.

We reserve the right to suspend, restrict, disable, or terminate access to the Services if we suspect fraudulent, abusive, unlawful, harmful, non-compliant, or policy-violating activity, as further described in our Terms of Service.

Service Availability and Modifications

We do not guarantee that the Services, including software, digital courses, membership areas, webinars, online platforms, integrations, Communications features, analytics, APIs, or other features, will be uninterrupted, timely, secure, error-free, or available at all times. Services may be unavailable due to maintenance, updates, system failures, third-party dependencies, network outages, carrier issues, force majeure events, or circumstances beyond our control.

We reserve the right to modify, update, suspend, discontinue, restrict, or remove any part of the Services, features, content, integrations, platforms, or functionality at any time, with or without notice, subject to applicable law and contractual obligations. We shall not be liable for any loss, damage, or inconvenience resulting from downtime, interruptions, carrier issues, delivery failures, service changes, or discontinuation, except to the extent required by law.

Retention of Personal Information

We retain Personal Information for as long as reasonably necessary to carry out the purposes described in this Policy, provide the Services, maintain accounts, support Customers, comply with legal obligations, resolve disputes, enforce agreements, detect and prevent fraud, maintain security, preserve records, and operate our business.

Retention periods vary depending on the type of information, the context in which it was collected, the sensitivity of the information, legal requirements, contractual obligations, operational needs, and security considerations. Usage data and diagnostic data may be retained for shorter periods unless needed for security, fraud prevention, service improvement, legal compliance, or dispute resolution.

For Customer Data, deletion and return obligations may be governed by the Agreement and DPA. After termination or expiration of a Customer account, we may delete, anonymize, or retain Customer Data as permitted by the Agreement, the DPA, applicable law, and our backup, archival, legal, security, and recordkeeping practices.

Your Rights and Options

Depending on your location and your relationship with us, you may have rights to access, correct, delete, restrict, object to, or receive a portable copy of certain Personal Information; to opt out of certain sales, sharing, targeted advertising, or profiling; to limit use of certain sensitive Personal Information; to withdraw consent; or to appeal a decision regarding a privacy request.

You may submit a privacy request through https://www.webinarfuel.com/datarequest or by emailing privacy@webinarfuel.com. We may ask you to provide information necessary to verify your identity, confirm your authority, locate relevant records, and process your request. We will respond within the time required by applicable law.

If you are an End User of one of our Customers, please contact the Customer directly regarding requests relating to Personal Information the Customer collected or processed through the Services. Because Webinar Fuel generally acts as a processor/service provider for Customer Data, we may refer your request to the relevant Customer, require Customer authorization before acting, or assist the Customer as required by the DPA and applicable law.

We will not discriminate against you for exercising privacy rights, although certain choices may affect our ability to provide portions of the Services. If we offer a financial incentive or loyalty program involving Personal Information, we will provide any notices and obtain any opt-in consent required by law.

Children's Privacy

The Services are intended for individuals 18 years of age or older and are not directed to children under the age of 13. We do not knowingly collect Personal Information from children under 13. If we become aware that a child under 13 has submitted Personal Information to the Services, we will take reasonable steps to delete that information and will not use it for any purpose except as required or permitted by law.

If you believe a child has provided Personal Information to us, please contact privacy@webinarfuel.com. We encourage parents and guardians to talk with children about the risks of providing information online.

How We Protect Personal Information

We implement and maintain reasonable administrative, technical, organizational, and physical safeguards designed to protect Personal Information against unauthorized access, loss, misuse, disclosure, alteration, or destruction. Our safeguards may include access controls, authentication protocols, encryption or secure transmission where appropriate, logging and monitoring, backup and recovery mechanisms, employee confidentiality obligations, security training, vendor oversight, and incident-response procedures.

Access to Personal Information is limited to personnel, contractors, and service providers with a legitimate business need to know or process the information. We periodically review and update our security measures in light of business needs, legal requirements, technology changes, and foreseeable risks.

No method of transmission or storage is completely secure. We cannot guarantee that information, whether during transmission, while stored on our systems, or while processed by service providers, will be free from unauthorized access, loss, misuse, destruction, alteration, or interception. Except for duties required by applicable law, we disclaim liability for unauthorized access to, theft or loss of, damage to, or interception of data or communications to the fullest extent permitted by law.

If we become aware of a security incident involving Personal Information, we will investigate and respond in accordance with our incident-response procedures and applicable law. Where required, we will notify affected Customers, individuals, regulators, or other parties. We also require certain vendors and business partners to notify us if they have reason to believe an incident affecting Personal Information provided by us has occurred.

External Sites, Apps, Links, and Social Media

We may maintain a presence on external social media platforms such as X, Facebook, Instagram, YouTube, LinkedIn, and other platforms. The Services may also contain links to websites, apps, integrations, platforms, or services controlled by third parties.

We are not responsible for the content, privacy practices, security practices, or data collection practices of third-party sites, apps, platforms, integrations, or services. Those third parties are not controlled by us and may have their own privacy policies and terms. You should review their policies and contact them directly with questions about their practices.

California Privacy Rights and Notice at Collection

This section applies to California residents and is intended to satisfy notice obligations under California privacy laws, including the California Consumer Privacy Act as amended by the California Privacy Rights Act (collectively, "CCPA/CPRA"). For purposes of this section, terms such as "personal information," "sensitive personal information," "business," "service provider," "contractor," "sell," and "share" have the meanings assigned under California law.

Depending on your interactions with us, we may collect the following categories of Personal Information:

Identifiers, such as name, email address, postal address, phone number, IP address, account name, online identifiers, and similar identifiers;
Personal information described in California Civil Code Section 1798.80, such as name, address, telephone number, payment information, and related customer records;
Commercial information, such as products or services purchased, obtained, considered, subscription status, billing records, credits, transaction history, and customer-service history;
Internet or other electronic network activity information, such as browsing history, search history, interactions with websites, applications, advertisements, emails, webinars, and Services;
Geolocation information, such as approximate location derived from IP address and, if enabled, more precise location data;
Audio, electronic, visual, or similar information, such as support calls, webinar participation, recordings, chats, or uploaded media where applicable;
Professional or employment-related information, such as company, title, role, business information, applicant information, or vendor information;
Inferences drawn from other information, such as preferences, interests, usage trends, likely product interests, or advertising segments; and
Sensitive Personal Information, such as account login credentials, payment-related information, or precise geolocation only where collected and permitted. We do not use or disclose Sensitive Personal Information for purposes that require a right to limit under California law unless we provide the required notice and choice.

Personal Information does not include publicly available information, deidentified or aggregated information, or information excluded from the scope of applicable privacy laws.

Sources of Personal Information

We collect Personal Information from you directly, from your devices and interactions with the Services, from Customers, from affiliates, from vendors and service providers, from advertising and analytics partners, from payment processors, from fraud-prevention providers, from social media platforms, from integration partners, and from other sources described in this Policy.

Purposes for Collection, Use, Disclosure, Sale, or Sharing

We collect, use, disclose, sell, or share Personal Information for the business and commercial purposes described in this Policy, including providing and improving the Services, processing transactions, providing support, securing the Services, detecting fraud, complying with law, sending marketing where permitted, measuring advertising, and enabling Customers to use the Services. We do not sell Personal Information for money. Some disclosures for cross-context behavioral advertising, targeted advertising, analytics, or measurement may constitute a "sale" or "sharing" under California or other state laws.

Your California Rights

California residents may have the right to request access to categories and specific pieces of Personal Information, correction of inaccurate Personal Information, deletion of Personal Information, portability, information about disclosures, opt-out of sale or sharing, limitation of use of Sensitive Personal Information where applicable, and non-discrimination for exercising rights.

California "Shine the Light" Disclosure

Other U.S. State Privacy Rights

Residents of Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Delaware, Iowa, Indiana, Tennessee, Montana, Florida, New Jersey, New Hampshire, Nebraska, Kentucky, Maryland, Minnesota, Rhode Island, and other states with applicable privacy laws may have additional privacy rights, depending on the law and their relationship with us. These rights may include the right to access, correct, delete, obtain a copy of, or opt out of certain processing of Personal Information, including targeted advertising, sale of Personal Information, or profiling in furtherance of decisions that produce legal or similarly significant effects.

Some states provide residents or authorized agents with the right to opt out of the sale or sharing of Personal Information, or targeted advertising based on Personal Information. To submit an opt-out request, use any applicable "Do Not Sell or Share My Personal Information" or similar link available on our Services, use our online request form, enable a legally recognized opt-out preference signal where supported, or email privacy@webinarfuel.com with the subject line "Do Not Sell or Share My Personal Information." Your request should include your email address, first name, last name, country, state, and enough information for us to process and verify the request.

EU, UK, Swiss, and International Privacy Rights

If you are located in the European Economic Area, United Kingdom, Switzerland, or another jurisdiction with similar data-protection laws, you may have additional rights under applicable law. For Personal Information that Webinar Fuel collects directly as a controller, we process Personal Information based on the legal bases described above. For Customer Data processed on behalf of Customers, Webinar Fuel generally acts as a processor and the Customer is responsible for responding to End User requests.

Rights of Data Subjects

Subject to applicable conditions and exemptions, you may have rights to request access, correction, deletion, portability, restriction, objection, withdrawal of consent, information about processing, and the right to lodge a complaint with a data-protection authority. To exercise rights for information we control, contact privacy@webinarfuel.com. For information controlled by one of our Customers, please contact that Customer directly.

Cross-Border Transfers

If we transfer Personal Information from the EEA, UK, Switzerland, or another jurisdiction to a country that has not been deemed to provide adequate protection, we use appropriate safeguards where required by law. These safeguards may include standard contractual clauses, the UK International Data Transfer Addendum, adequacy mechanisms, vendor contractual commitments, and other lawful transfer mechanisms. By using the Services, you acknowledge that your information may be transferred to and processed in jurisdictions whose data-protection laws may differ from those of your country of residence.

Online Tracking Technologies, Advertising, and Opt-Out Signals

We, our service providers, and third parties may collect information about your activity, or activity on devices associated with you, on our Services and on third-party sites and applications using tracking technologies such as cookies, pixels, tags, scripts, web beacons, local storage, software development kits, application programming interfaces, mobile identifiers, and similar technologies. We may collect information whether or not you are logged in or registered and may associate tracking data with your account, device, browser, or other information where permitted by law.

These may be used to deliver relevant advertising, measure ad impressions, measure conversions, create or use custom audiences, suppress ads, analyze campaigns, and personalize content across our Services and third-party sites and applications.

Pixel tags, web beacons, scripts, SDKs, and APIs. These may collect information such as IP address, URL, page views, clicks, event data, browser type, cookie identifiers, device identifiers, and the time and duration of interactions. Similar functionality may be enabled in mobile applications or connected services through SDKs or APIs.

Tracking data may be used to simplify your experience, deliver relevant content and advertising, monitor, evaluate, measure, and optimize the use and operation of the Services and advertising, analyze traffic, detect fraud and security issues, and improve our products and services.

Targeted Advertising, Custom Audiences, and Social Platforms

We may use Personal Information to deliver relevant marketing and advertising on our Services and on third-party sites and applications. We may provide social media platforms, advertising networks, and other partners with limited information, such as cookie identifiers, device identifiers, event data, or hashed email addresses, which they may match to their own user profiles to show ads, find similar audiences, suppress ads, measure conversions, and provide insights. These practices may be considered selling, sharing, or targeted advertising under certain laws, and you may have opt-out rights.

Managing Cookies and Advertising Choices

You may be able to control cookies through your browser settings. If you block or delete cookies, some Services may not function properly, and you may need to re-enter preferences. Browser and device settings may also allow you to control certain tracking, advertising identifiers, or mobile permissions. You may also be able to opt out through industry tools, advertising platforms, or settings offered by third-party providers. Opt-outs may be specific to a browser, device, or digital property and may need to be repeated if you clear cookies, use another browser, or use another device.

Global Privacy Control and Do Not Track

Some browsers and tools allow you to communicate opt-out preferences automatically, such as the Global Privacy Control (GPC) or other opt-out preference signals. Where required by applicable law, we will process legally recognized opt-out preference signals as requests to opt out of sale, sharing, or targeted advertising for the browser or device sending the signal.

Some browsers have a "Do Not Track" feature. Because there is not a uniform industry standard for responding to Do Not Track signals, we do not specifically respond to browser Do Not Track signals unless required by applicable law. This does not affect our handling of legally recognized opt-out preference signals where required.

Authorized Agents

You may authorize another person to make a privacy rights request on your behalf where permitted by law. Authorized agents may be required to demonstrate that they are authorized to act on your behalf, provide proof of authority, verify their own identity, and enable us to verify your identity or confirm authorization directly with you. An authorized agent may not use Personal Information collected from or about you for any purpose other than fulfilling your request, verification, or fraud prevention.

Sensitive Information

We do not seek to collect sensitive Personal Information unless necessary to provide the Services, process payments, secure accounts, comply with law, or support features you or a Customer choose to use. Please do not provide sensitive information unless requested or necessary. Customers are responsible for ensuring that Customer Data uploaded to the Services is appropriate and lawful for processing through the Services and that any sensitive data is collected and processed in compliance with applicable law.

International Use

Webinar Fuel controls and operates the Services from the United States. If you use the Services from outside the United States, you are responsible for compliance with local laws where applicable, and your information may be transferred to, stored in, accessed from, or processed in the United States and other countries. The Services may not be appropriate or available for use in all jurisdictions.

Changes to This Privacy Policy

This Policy is effective as of the date stated above. We reserve the right to change, update, or modify this Policy from time to time. Updates will be posted on our Services or otherwise made available as required by law. All information collected is subject to the Policy in effect at the time of processing unless otherwise required by law. Your continued use of the Services after changes are posted constitutes your acknowledgement of the updated Policy.

The English-language version of this Policy is the controlling version regardless of any translation you may attempt or obtain.

Relationship to Terms of Service and Data Processing Addendum

This Policy is incorporated into and subject to our Terms of Service and, where applicable, our Data Processing Addendum. In the event of any conflict between this Policy and the Terms of Service, the Terms of Service control except to the extent a contrary result is required by applicable privacy law. In the event of any conflict regarding processing of Customer Data where the DPA applies, the DPA controls to the extent provided in that agreement.
